Client Contract

For the purposes herein after this contract is a binding accord between Cowger Entertainment LLC, herein after referred to as “Agent” and _________________________________ herein after referred to as “Client.”
This accord is considered a legal agreement between the above listed parties. This agreement is considered in effect upon the entertainer receiving the accord.
The client is responsible for reading, understanding and ad hearing to the terms and conditions as listed within. Cowger Entertainment will make every attempt to hold the requested date but does not guarantee an entertainer for any event until a signed contract is returned to Cowger Entertainment. All contracts MUST be returned to Cowger Entertainment within thirty (30) days of the mailing of the contract. Failure to return the contract within the 30 day period shall make the contract null and void.
The Client agrees to the following terms and conditions as set forth by Cowger Entertainment.
1) Cowger Entertainment LLC is a professional entertainment corporation which specializes in providing DJ’s, Emcees and Music for special events. Cowger Entertainment shall provide a DJ and all necessary equipment to provide sound for the desired event.
2) Cowger Entertainment carries equipment that meets a professional level to ensure good clear sound. Cowger Entertainment also carries with them a backup sound systems incase of equipment failure. Cowger Entertainment cannot guarantee sound quality for outdoor events or rooms with no sound absorbers.
3) Cowger Entertainment makes every attempt to keep all equipment in top working order and cannot be held responsible for complete equipment failure. In the event of equipment failure a refund for the remainder of the event shall be given.
4) Cowger Entertainment will perform outdoor venues, however outdoor venues require the entertainer be provided with a tent at least 8’ by 8’. The client hereby also agrees that a complete performance by the DJ is not guaranteed for outdoor venues.
5) Cowger Entertainment cannot perform outdoor venues when the temperature is above 97 degrees or temperatures below 40 degrees.
6) If in the event of rain Cowger Entertainment must protect all equipment at all cost. If the rain forces the entertainer to stop performing, after 30 minutes non performance by the entertainer, the event is considered to be over.
7) For safety reasons, Cowger Entertainment is unable to perform outdoors in heavy rain, constant rain, extremely winds conditions or thunder and lightning storms. This policy is to protect the Clients, Guest, and Performers from injury.
8) If during any venue a severe lightning storm erupts, Cowger Entertainment shall immediately stop the performance and disconnect from any power outlet to protect the equipment. If after 30 minutes the storm has not passed the event is deemed to be over for safety reasons.
9) *For venues that require traveling through restricted access passages such as, narrow side roads, bridges, water ways etc… If it is unsafe for the performer to cross such areas the entertainer shall be unable to perform at the venue and the deposit if forfeited.

10) *For remote areas such as Islands; if the waterway to be taken is choppy or rough causing waves to come into the deck area of the vessel the performer shall be unable to perform at the venue. The performer shall notify the client of the inability to cross the waterway as soon as applicable. Cowger Entertainment is unable to perform due to the risk of damage to equipment. The deposit will not be refunded. The client is responsible for transportation to and from the island the day of the event and is responsible for all fees for the entertainer and their agents.
11) *Cowger Entertainment will not perform or travel during severe hurricanes, tornadoes, severe weather, severe winds, severe downpours, tsunamis, areas of flooding, unforeseen weather conditions, acts of war, acts of God or any other type of condition that is deemed to be a safety risk to performers. If while traveling the performer encounters any of the above conditions, the performer will notify the client of the unsafe conditions and cease any further travel to that destination.
12) *Cowger Entertainment leaves well in advance to arrive early to events. However Cowger Entertainment cannot be held responsible for delays due unforeseen to heavy traffic conditions, road closures, road repair, traffic accidents and any other unforeseen conditions.
13) *In rare situations of a family or medical emergency, Cowger Entertainment will be unable to perform at the venue a replacement DJ will be sought to cover the event. If no other DJ is available the Client shall be notified as to the reason and all monies shall be refunded.
14) If the client pays in full for the event and the Client cancels the venue the balance shall be refunded however the deposit is non refundable. The balance will be refunded within 10 business days.
15) While performing at a venue the entertainer shall not encounter any physical or verbal abuse from any guest, visitor, agent, staff member, or other person at the venue. In the event of verbal abuse the person in charge of the event shall be notified of the situation. If the problem persists, the person(s) involved shall be removed from the event by the person in charge of the event or their designated agent. FAILURE TO REMOVE THE PERSON WILL RESULT IN Cowger Entertainment terminating the contract and ceasing any further services for the venue and the full amount shall still be due to Cowger Entertainment.
16) In the event of physical abuse or attempted physical abuse in any degree towards the entertainer or any of their agents SHALL result in immediate termination of the contract and ceasing of any further services towards the event. The client shall still be responsible for the remainder of the balance due.
17) At any venue the CLIENT assumes FULL RESPONSIBILTY for the entertainer’s equipment. The client is responsible for any damages to equipment whether accidentally or damage with a malicious intent. Damage in any degree may terminate the contract. If the entertainer feels it is necessary to cease performance, they may do so and the client is still responsible for the payment balance.
18) If a replacement entertainer is used Cowger Entertainment is not responsible for the performance of the entertainer.
19) There will be a $50.00 returned check fee for any returned checks.
20) The client is responsible for the payment of the BALANCE DUE at the time of the event. If the client is not satisfied with the entertainer the client must still pay the balance due and notify Cowger Entertainment in writing as to the problem.
21) Failure to pay the remainder of the balance is considered “Theft of Services” and is a Criminal Act under Maryland, Delaware and Virginia Law. Failure to pay will result in the immediate notification of the local Law Enforcement Agency. If

payment is not received at the time of services the client has (10) ten days to pay the balance or civil action shall be taken. If Criminal or Civil action is taken the client is responsible for the balance due, plus any interest per day, Court Cost, and any and all Lawyers fees associated with the matter.
22) The “Wedding Planner” form and reception information form must also be completed on-line at www.cowgerentertainment.com within 5 days prior to the event. Failure to turn in the wedding planner form with an introduction line up shall result in introduction forfeiture.
23) Our song list is available for viewing at www.cowgerentertainment.com. If a song you want played at your venue is NOT listed on our site we do not have it. If you would like that song played you can either provide it on a CD or we can download it for you. There is a 5 song download limit. After 5 songs you must bring any requested music on a CD.
24) All of our music at Cowger Entertainment is “Radio Edit” meaning it meets the requirements of the FCC (Federal Communication Corporation) and the song can be played on any local radio station.
25) Time Starts at the agreed upon start time listed below or when the first guest arrives. The entertainer will arrive approximately 1 hour before the event.
26) If a second sound system is required for the event there will be an additional $125.00 charge.
27) Any venue that is 4 hours or longer Cowger Entertainment shall be provided with a hot meal. Cowger Entertainment and its agents shall be provided the same meal as to what the guest are receiving. If a meal is not provided the DJ and agents are entitled to leave for 30 minutes to purchase a meal. Cowger Entertainment is not responsible for any part of the event that is missed while the entertainers are gone.
28) On occasion Cowger Entertainment may take photographs while at venues for advertising purposes. Photographs will not interfere with the contracted event photographer or affect the DJ’s performance. Cowger Entertainment/Photography shall own the copyright for all images created at the event and shall have exclusive right to make reproductions. Cowger Entertainment/Photography shall only make reproductions for the Client or for the Photographer’s portfolio, studio samples, self promotions, entry in photographic contests or exhibitions, instructional purposes, editorial use, or within or on the outside of The Photographer's studio. Any such use will be judicious and consistent with the highest standards of taste and judgment. If the Photographer desires to use images for uses other than those specified above, the Studio shall not do so without first obtaining written permission from the Client.
29) To ensure quality performance we only book one event per day. Due to the specific demand after a date has been booked we will refuse any other events on that day. Since we cannot guarantee a replacement for that spot any event cancelled less than 6 months from the venue date deems the deposit shall be non-refundable.
By signing below all parties as listed above agree to these terms and conditions as listed above. Any violations of the conditions as listed above are a breach of contract and are grounds for the entertainer to leave the venue and the client is responsible for the full balance owed.
